Law on resilience of critical entities, promulgated
President Klaus Iohannis promulgated on Tuesday the law initiated by the Government on the resilience of critical entities, according to which the National Center for Coordination of the Protection of Critical Infrastructures (CNCPIC) within the Ministry of Internal Affairs is the single point of contact in the relationship with the European Commission and the other member states.
The normative act establishes the legal framework regarding the identification of critical entities, their support in order to strengthen resilience, as well as the improvement of cross-border cooperation between the competent authorities in order to ensure the provision of essential services on the internal market of the European Union. The law transposes Directive (EU) 2022/2557 of the European Parliament and of the Council of December 14, 2022 on the resilience of critical entities.
According to the normative act, critical entities are public or private entities that provide one or more essential services, play an indispensable role in maintaining societal functions or vital economic activities on the internal market, in an increasingly interdependent European Union economy.
CNCPIC becomes the competent authority at the national level, responsible for coordinating the activities carried out by the competent sectoral authorities (ACS).
The provisions of the normative act will not be applied to public administration entities that carry out their activities in the field of defense, public order and national security, including in what concerns the investigation, detection and prosecution of crimes. Other exceptions refer to the banking sector, the financial market infrastructure sector and the digital infrastructure sector.
By decision of the Government, the Strategy on the resilience of critical entities is approved until January 17, 2026, the normative act also provides.
